Official Summary, Pros and Cons

Bars state/local governments from condemning or damaging private property to promote other private projects, uses. Limits government’s authority to adopt certain land use, housing, consumer, environmental, workplace laws/regulations. Fiscal Impact: Increased annual government costs to pay property owners for losses to their property associated with new laws and rules, and for property acquisitions. These costs are unknown, but potentially significant on a statewide basis.)

A YES vote on this measure means: State and local governments would have
significantly increased requirements to compensate property owners for
economic losses to their property resulting from new laws or rules. Also,
government would be more restricted in taking private property for public
uses.

A NO vote on this measure means: There would be no changes in the
requirements on government for: (1) paying for economic losses to property
resulting from new laws and rules and (2) taking private property for public
purposes.

Dear Friends,

Proposition 90 is a stealth bomber. Financed by a New York state developer, it is designed to remove all land-use considerations other than monetary profits for the land-owner.

This bill would prevent city, county, and state representatives from impacting development for reasons of: open space, water pollution, surrounding property value, low income housing, traffic congestion, you name it. WalMart would reign supreme.

I recently heard a progressive city council member say that if Prop 90 passes, he would resign because he would be helpless to take meaningful action at the city level.

And here's the final rub. For those of you who think that Proposition 90 has anything to do with protecting average home and business owners from having their property taken by eminent domain, I urge you to read the language of the bill. See the third to last paragraph on page 188 of your voters' guide: "(e)Nothing in this section shall prohibit the use of condemnation powers to abate nuisances such as blight..." According to news stories across the country, "blight" is the very tool used to take low to middle class homes and businesses for the profit of big development.
